Terms of Use

These Terms are a contract between you and Nicholas Cupo, the developer of JoyRidr, Florida, USA ("JoyRidr", "we"). You accept them when you tap "I Agree" in the app. If you do not agree, do not use the app. Please read sections 2 (Riding is dangerous), 5 (No warranty), 6 (Limit of liability) and 8 (Disputes) carefully. They limit your rights.
1. Who can use JoyRidr
You must be at least 18 years old and hold a valid licence or endorsement to ride a motorcycle where you ride. JoyRidr is not intended for anyone under 18. You may use JoyRidr only where doing so is lawful.
2. Riding is dangerous, and you accept that risk
Motorcycling carries a risk of serious injury and death. You choose where, when, how fast and whether to ride. JoyRidr does not.
JoyRidr is a planning and navigation aid. It is not a safety device. Routes, turn directions, lane guidance, speed limits, hazard call-outs (such as bends, unpaved surface, steep descents and railway crossings), scenery ratings, fuel stops, range estimates, weather and daylight information are generated automatically from third-party map and weather data that is often incomplete, out of date or wrong. JoyRidr cannot see the road. It does not know about closures, construction, debris, gravel, oil, water, ice, animals, traffic, other road users, or the condition of your motorcycle or of you.
A hazard call-out may be missing, late or wrong. The absence of a call-out does not mean the road ahead is clear or that your speed is appropriate. A route described as quieter, or as having fewer left turns, is not a safer route and may be more demanding. A suggested road may be private, closed, unpaved or unsuitable for your motorcycle or your skill.
You agree to: obey all traffic laws, signs and signals; ride within your ability and the conditions; wear protective gear; set up your route before you ride; not look at or touch your phone while moving; and trust what you see over anything JoyRidr says or shows.
To the fullest extent the law allows, you knowingly and voluntarily assume all risks of using JoyRidr while riding, including the risk of property damage, injury and death, and including risks that arise from JoyRidr's own negligence.
3. Not for emergencies
JoyRidr does not detect crashes, contact emergency services or share your location with anyone. Do not rely on it in an emergency.
4. Beta versions
Pre-release versions (for example through TestFlight) are unfinished, will contain errors and may stop working without notice. You use them at your own risk and agree to tell us about problems you find.
5. No warranty
JOYRIDR IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ROUTES, DIRECTIONS, SPEED LIMITS, HAZARD CALL-OUTS, FUEL, WEATHER OR OTHER INFORMATION ARE ACCURATE, COMPLETE OR CURRENT, OR THAT THE APP WILL WORK WITHOUT INTERRUPTION. Nothing we say in the app, on our website, in a store listing or in a message creates a warranty. Some places do not allow some of these exclusions, so parts of this section may not apply to you.
6. Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, JOYRIDR AND ITS OWNERS, CONTRACTORS AND DATA PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, FINE, TOWING OR RECOVERY COST, OR LOSS OF DATA, ARISING FROM OR RELATED TO JOYRIDR OR THESE TERMS, WHATEVER THE LEGAL THEORY (INCLUDING NEGLIGENCE AND PRODUCT LIABILITY) AND EVEN IF WE WERE TOLD IT WAS POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) WHAT YOU PAID US FOR JOYRIDR IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) US $50. These limits do not apply to liability that the law does not allow us to limit, such as for gross negligence or intentional misconduct. You agree these limits are a fair allocation of risk for an app provided free or at low cost.
7. You cover claims caused by your riding
If someone else brings a claim against JoyRidr because of how you rode, your breach of these Terms or your violation of law, you will defend and indemnify JoyRidr and its owners against that claim, including reasonable legal fees, to the extent the law allows.
8. Disputes
Talk to us first. Before filing any claim, email support@joyridr.app with a description. We will each try in good faith for 30 days to resolve it.
Governing law. Florida law governs these Terms and any dispute related to JoyRidr, without regard to conflict-of-law rules.
Courts. Any dispute will be brought only in the state or federal courts serving Pasco County, Florida, and you and we consent to those courts. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL and agree that claims may be brought only individually, not as a plaintiff or class member in any class or representative action.
9. Your content
Rides and routes you create are yours and stay on your device. If you share a GPX file, you decide who gets it.
10. Acceptable use
Do not misuse the service: no automated bulk requests to our servers, no attempts to disrupt them, and no use of JoyRidr for unlawful purposes.
11. Third-party data and services
Map data is © OpenStreetMap contributors and available under the Open Database License (openstreetmap.org/copyright). JoyRidr also uses OpenFreeMap, Geoapify, the US National Weather Service and others listed in the app under About. These providers do not endorse JoyRidr, make no warranty to you, and are not liable to you. Their services can change or stop.
12. Apple
If you got JoyRidr from the Apple App Store or TestFlight: these Terms are between you and JoyRidr only, not Apple. Apple is not responsible for JoyRidr or its content, has no obligation to provide maintenance or support, and, to the fullest extent the law allows, has no warranty obligation for it beyond refunding any purchase price. Apple is not responsible for addressing any claim relating to JoyRidr, including product-liability, legal-compliance, consumer-protection or intellectual-property claims. Your licence is a non-transferable licence to use JoyRidr on Apple devices you own or control, as allowed by the App Store usage rules. You confirm that you are not in a country under US embargo or on a US restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
13. Changes
We may change these Terms. If a change is material, the app will show you the new Terms and ask you to agree before you continue. Changes do not apply to disputes that arose before you accepted them.
14. General
If a court finds part of these Terms unenforceable, the rest stays in effect and the unenforceable part is enforced as far as the law allows. These Terms and the Privacy Policy are the whole agreement between you and JoyRidr about JoyRidr. Our not enforcing a term is not a waiver. You may stop using JoyRidr at any time; sections 2 and 5 to 8 continue to apply.
